所谓权利成立抗辩、权利消灭抗辩和权利阻碍抗辩

 

     上课给学生讲抗辩和抗辩权,具体区分权利成立抗辩、权利消灭抗辩和权利阻碍抗辩。为了怕小孩子们听不懂,特别提倡用日常生活经验和智慧来理解法律。

     本人以身作则,告诉他们说:所谓权利成立抗辩、权利消灭抗辩和权利阻碍抗辩,就是被告针对原告的三种最基本策略,也是日常生活中吵架一方针对另一方指控的三种基本态度,尤其是在男女朋友吵架中。

      比如一方女(或男)指控对方说:某年月日,对方曾经背着她(或他),和某第三个女(或男)一起到某某地干什么。针对对方这种指控,生活中(也是戏里常有)的另一方男(或女)常见三种回答:

     (1)完全否认,誓死捍卫自己清白,并指责对方无中生有、无理取闹。(这是主张对方的请求权从不成立,此即权利成立抗辩)

     (2)承认有这回事,但认为事情已经过去了,因为自己已经道过歉,而对方也已经原谅了,所以不用再道歉。(这是承认对方的请求权曾经成立,但主张该请求权事后已经消灭了,此即权利消灭抗辩)

     (3)承认有这回事,但指责对方也曾经干过这种事,所以自己无需道歉。(这是主张对方的请求权确实成立,而且一直还在,但是自己有正当理由而可以拒绝履行义务,此即权利阻碍抗辩,或称抗辩权)。   

      哈哈,课后想想这个例子举得还是很有创意的,分享分享一下下。

“学生”的秘密——学习生存、学习生活、学习生气

     

     “学生”,再普通不够的词,有什么秘密可言?

     “学生”本来就是“生人”,是菜鸟,什么都需要学习。最普通的“学生”含义就是“正在学习的生人(菜鸟)”,是student。(Student:1398, from O.Fr. estudient "one who is studying," from M.L. studiare "to study," from L. studium (see study). Student-teacher is attested from 1907. )

      中文“学生”二字很牛,意思不只这么多,因为“生”字很厉害。

     “学生”是“学习生存”和“学习生活”,这是“学生”作为“pupil”的本意。pupil本意指孤儿、未成年人,其还不会自己生存、自己生活,需要别人照顾,因此必然有学习生存和学习生活之需要。(Pupil:"student," 1382, originally "orphan child, ward," from O.Fr. pupille (14c.), from L. pupillus (fem. pupilla) "orphan, ward, minor," dim. of pupus "boy" (fem. pupa "girl"), probably related to puer "child," probably from PIE *pup-, from base *pu- "to swell, inflate." Meaning "disciple, student" first recorded 1563. )

  “学生”还要“学会生气”。并不是人人都会生气,根据亚里士多德的“生气”论,会生气是指:在适当的时间,针对适当的事,对适当的人,发适当程度的脾气。这是很难做得到的,很多人不会生气,学生经常更不会生气。学生经常会怒气冲冲,发愤报复,比如“塔利班”这类“学生”。(Taliban Look up Taliban at Dictionary.com Sunni fundamentalist movement in Afghanistan, Pashto pl. of Arabic tālib "student;" so called because it originated among students in Pakistani religious schools. Group formed c.1993. Often incorrectly treated as singular in English. )

笑博士

 

     前些日子清理博文,竟把“笑博士”一篇误删,今补录在此,以提醒某些老想读“博士”的小姐先生们。

     “博士”,常被当作“博学之士”,经常却是“浅薄之士”——“薄士”,脑袋浅薄、钱包浅薄或者脑袋钱包皆浅薄。

     可怜“博士”,常也易被“驳死”——“博士博士,一驳就死”。

井底之蛙窥见了井外世界之后

   

井底之蛙,幸福生活着;费尽辛苦,一天终于在井盖旁窥见井外世界。

井底之蛙窥见了井外世界后,不同的蛙作了不同的选择:

一是看不懂,也不想再看,重新跳回井内生活;

二是深深着迷于井外世界,从此不想再回井内,希望在井外生活;

三是到井外世界游荡,但再次跳入另一口井中,过井内生活;

四是坚决改造水井,使得没有井内和井外之分;

五是试图改造井外世界,使得没有井内和井外之分;

六是不想做蛙,想做大雁、狮子、老虎、袋鼠或者其他什么。

井底蛙还会选择其他吗?

开始澳门第二年

 

    前几日和老朋友们在厦门商务会馆聚餐,竟凑巧是一周年在老地方的重逢,人依旧,改变的只是时间。

    今日搬了新办公室,又住进了新公寓。新办公室算是宽敞明亮,新公寓布置得像小宾馆,有点意外。

    澳门第二年的开始,还不错。
